1. General
1.1 These Terms & Conditions apply to all offers, orders, and agreements made through canaldelaville.com, Etsy.com, and private sales via external platforms like Facebook, Instagram etc.
1.2 By placing an order, the customer agrees to these Terms & Conditions.
1.3 Any deviations from these Terms are only valid if agreed upon in writing.
2. Nature of the Products
2.1 Canal de la Ville specializes in antique and vintage copper cookware, including tin-lined and silver-lined pieces and sometimes stainless lined items.
2.2 Due to the age and history of these items, signs of wear, patina, minor imperfections, surface marks, and historical repairs may be present and are considered part of the character and authenticity of the product.
2.3 All products are described and photographed as accurately as possible. However, slight variations in color, tone, measurements, and condition may occur and do not constitute grounds for cancellation or claims.
2.4 The buyer acknowledges that antique and vintage cookware differs from newly manufactured items and requires proper care and maintenance.
3. Use & Maintenance
3.1 Tin-lined and silver-lined copper cookware requires appropriate use. Overheating, dry heating, use of metal utensils, dishwashers, or improper cleaning may damage the lining.
3.2 Products are sold in their current condition. It is the buyer’s responsibility to ensure that each item is thoroughly cleaned, properly maintained, and suitable for its intended use prior to use. Canal de la Ville Copper Cookware disclaims any liability resulting from failure to do so.
3.3 Canal de la Ville is not liable for damage caused by improper use, overheating, or lack of maintenance after purchase.
3.4 Buyers are responsible for understanding how to properly use and care for traditional copper cookware.
3.5 Unless explicitly stated otherwise in the product description, items sold are not suitable for use on induction cooktops.
4. Pricing
4.1 All prices are listed in Dollars (USD) unless stated otherwise.
4.2 Prices include VAT where applicable, unless otherwise indicated.
4.3 Shipping costs are calculated separately at checkout, unless complimentary shipping has been expressly agreed upon in writing prior to completion of the purchase
5. Orders & Payment
5.1 An agreement is concluded once the order has been confirmed and payment has been received.
5.2 “Orders are dispatched once full payment has been received, unless a later shipment date has been mutually agreed upon or requested by the buyer.
5.3 Canal de la Ville reserves the right to refuse or cancel orders in case of pricing errors or availability issues.
6. Shipping & Delivery
6.1 Orders are shipped to the address provided by the customer. Should the shipping address be changed after the order has been placed, any resulting additional costs shall be borne by the buyer
6.2 Delivery times are estimates and cannot be guaranteed.
6.3 Canal de la Ville is not responsible for delays caused by shipping carriers or customs authorities.
6.4 Risk of loss or damage transfers to the buyer once the package has been handed over to the shipping carrier.
7. Import Duties & Customs
7.1 International shipments may be subject to import duties, customs fees, VAT, or other charges imposed by the destination country.
7.2 All import duties, customs charges, taxes, and related fees are the sole responsibility of the buyer, unless otherwise agreed in writing.
7.3 Canal de la Ville has no control over these charges and cannot predict their amount.
7.4 Refusal to pay customs charges resulting in returned shipments may lead to deduction of shipping and handling costs from any refund.
8. Returns & Right of Withdrawal (EU Customers)
8.1 Customers within the European Union have the right to withdraw from their purchase within 14 days of receiving the item, without providing a reason.
8.2 The item must be returned in the same condition as received and carefully packaged.
8.3 Return shipping costs are the responsibility of the buyer unless otherwise agreed.
8.4 Custom orders or specially reserved items may be excluded from withdrawal rights.
8.5 Refunds will be issued after the returned item has been inspected.
9. Limitation of Liability
9.1 Canal de la Ville is not liable for damages resulting from improper use, overheating, or misuse of copper cookware.
9.2 Liability is limited to the purchase price of the item concerned.
9.3 Canal de la Ville shall not be liable for indirect, incidental, or consequential damages.
10. Authenticity & Condition
10.1 All items are sold as described and photographed.
10.2 Vintage and antique items are sold in their existing condition.
10.3 Minor imperfections consistent with age are not considered defects.
11. Governing Law
11.1 All agreements are governed by Dutch law.
11.2 Any disputes shall be submitted to the competent court in the Netherlands.
